- What if I mention to the cop with his K-9 the fact that a dog cannot be probable cause due to the existence of false positives and the fact that a common tactic for canine units is to induce a false positive for vehicles that they deem suspicious on a hunch alone?

- Say you are pulled over with marijuana. The marijuana has not been in the container long enough to permeate, and the outside of the container is not contaminated. The officer walks the dog around the vehicle and deliberately makes the dog false alert. How would you steer away from a situation like this when you know the officer has made the dog false alert?

- I have seen quite a few cash seizures on television. Any person with an IQ that runs above their age knows that 99.9 percent of all money in circulation today has at some point run into contact with dope. Rather than load the suspect cash in one bag and loading the others with clothes, toys, etc., why don't they use a cop’s wallet and a judge’s wallet? The dog would hit on all of them!

- What is our recourse if we see LEO making a "false alert?” If a cop gets caught doing a "false alert" with the K- 9, what punishment would he typically receive, if any? If I see it happen, what could I do? Is there a way to prove that the officer was causing a false alert just by looking at the video? Suppose we wanted to escalate that issue, would it just go to internal affairs? Would we be allowed to review the video being shot in the police car to help my defense? Is there any recourse to stop these false alerts?

- What are cops looking for when they tell us to “follow my pen with just your eyes…”? Can the person taking the test “influence” the outcome? This seems like another BS test that has whatever result the officer says it does. After all, no one can see a person’s eyes on the dash-cam.

- I frequently ride my bicycle on the road. Could a police officer pull over a cyclist riding a bicycle? Can a cop pull me over and request to search my bicycle, considering the marijuana was hidden out of view – maybe in the top-tube or something?

- I drove 8,200 miles across the country from Oregon to Maine then down to Florida. I now have 15,000 miles on my motorcycle, which is a cruiser style, and never have been pulled over once. I was wondering where motorcycles stand in the profiling mix?

- Barry, would you say the majority of the stops and/or searches you conducted took place in the day time or night time? I'm not sure if I've got some sort of security blanket, but I always felt safer picking up bud in the day time than at night time.

- Is smelling marijuana always a “probable cause” to search someone? I mean, any LEO who really wants to catch a load can stop anyone they want, claim that they smell marijuana, and then begin searching them. If the person did not have marijuana, the LEO lets him go. However, if the person did have marijuana, the person searched is now screwed in a court of law and cannot file a motion to suppress evidence as the officer "smelled" the marijuana in the first place, giving him probable cause to search.
