If a private residence has a dumpster located on the property that cannot be reached without going on the property, is it illegal for LEO to go through the dumpster?
When police are trying to get someones DNA, they will follow them around until they get a cup or cigarette butt, etc to get DNA. Is it possible for police to do that with something someone touched to try to get "dust" to see if they are smokers? I have heard that our local jail has installed a machine that you must touch to check for drugs on your hand before you can visit someone. I guess that is true. That got me to wonder about getting "dust" off something someone touches.

littlenut, yes they can go through your trash as soon as you dump it. now saying that. normaly you have to be a big dealer or someone the LEO'S want to catch. as far as going through a smokers trash, i dont think so.
and yes they can lift prints off baggies and find out who handeled the bag.

Thanks for your post. Let me clarify something, the only time the trash is removed from the property is when the big ol dumpster truck comes into my driveway, and lifts the dumpster up and empties it into their garbage truck. So my trash is never set to the curb for pick up. Based on that, it seems like what I am understanding is that the LEO cannot go through my trash under any circumstances legally. Am I correct?
Just researching here !

| If your trash is owned by a private companey Then they can. Privateer trash companey like in the country or haulers. usually let police officers into there cans because it is then considered there property. |

littlenut , just an example. if the person of interest is important enough and the LEOs want him/her. they will have a truck with no trash in it pickup the person of interest trash and they will have only it to sift through. 'just an example.'

I never thought of that.
Could.nt this evidence get thrown out in court do to the fact that they knew they were using an empty truck and that they already knew they were going to try to find some things.
Kinda sounds like entrapment to me. Or maybe I just don't understand the whole entrapment thing. |

This is common practice! One State recently decided a case that makes it more difficult for law enforcement to do this. Check your States 4th Laws.
That's why Barry suggests NOT putting your "stash trash" in the trash. Use it to smell proof your property. |
