WORTH A READ: Heres a small section regarding Flir and 4th Amendment from another forum. They have some great info!

Suspicious that marijuana was being grown in petitioner Kyllo’s home in a triplex, agents used a thermal imaging device to scan the triplex to determine if the amount of heat emanating from it was consistent with the high-intensity lamps typically used for indoor marijuana growth. The scan showed that Kyllo’s garage roof and a side wall were relatively hot compared to the rest of his home and substantially warmer than the neighboring units. Based in part on the thermal imaging, a Federal Magistrate Judge issued a warrant to search Kyllo’s home, where the agents found marijuana growing. After Kyllo was indicted on a federal drug charge, he unsuccessfully moved to suppress the evidence seized from his home and then entered a conditional guilty plea. The Ninth Circuit ultimately affirmed, upholding the thermal imaging on the ground that Kyllo had shown no subjective expectation of privacy because he had made no attempt to conceal the heat escaping from his home. Even if he had, ruled the court, there was no objectively reasonable expectation of privacy because the thermal imager did not expose any intimate details of Kyllo’s life, only amorphous hot spots on his home’s exterior.
Held: Where, as here, the Government uses a device that is not in general public use, to explore details of a private home that would previously have been unknowable without physical intrusion, the surveillance is a Fourth Amendment “search,” and is presumptively unreasonable without a warrant. hey socrateez, i'm going to reply because my comment is about FLIR- profiling. some years back i was a member of 'NORMAL', had subscription 'HIGH TIMES GROW' a subscription to CANNABIS CULTURE MAG., active via e-mail to congress about medical cannabis. and had spoke to 'michelle rainey BC-3' about canceling tokers bowl, 2 weeks before DEA arrested them. well about a month later i was sitting in my front room and heard an very low airplane, its 8:30pm fly almost over my house.i ran out side and saw the plane in the moonlight doing a U-TURN and comming back but he was about 50 feet south of his last run and then VOOOM right over my house i saw the big FLIR ball on the front of the small airplane, he went about a mile i could see his lights blinking well he did another U-TURN here he comes again about 50 feet more south, well i got my 1 MILLION watt candle power light and then VOOOM just off the south side of my house he passed then he did a U-TURN and thats when i LITE HIM UP with my light and he turned his plane toward me and shined a 10 million watt light on me i had my finger pointed in the air. he made 3 more passes then left the area. that was it i guess they saw i had nothing.

HaHaha! Thats funny! I gotta get me a flood light! Wait, is that illegal to do? Can you shine a light on a aircraft "for identification purposes"?? I know a laser would be out.
Interesting that they seemed to be making passes in your nieghborhood. I guess they could say they were targeting a specific house but the flight pattern sounds more like a grid search.

socrateez what you mean when you say GRID SEARCH. i forgot to ask that, because i dont understand what you mean. i dont live in a neighborhood. we call it the country here about 15 miles from the nearest town and my closest neighbor is 1/2 mile away from me. he was flying so low my satalite would lose picture when he would pass. i almost made a complaint, but thought, maybe thats what they want me to do, so they could come and enter my home. so did not make it.

A grid is on a map, usually 1 square mile. You can set any size grid you want though. We'll keep 1 mile for simplicity. Whats the best ways to search that square mile on the map? The same way you mow your lawn. Your "strips" in a plane are much wider though.
Circular paths are assumed when a area of interest is spotted and the plane will veer from its its grid path.
If a plane was looking at a specific location, I would expect it to circle at a distance and zoom in.
Barry is trained in this, perhaps he'll confirm or deny. |
