Canada, U.S. pot-bust deal for Emery has stalled

A deal between U.S. and Canadian authorities that would see Vancouver-based pot czar Marc Emery spend jail time in both countries has stalled.

"The Canadian government has told the United States they don't think the deal is workable under Canadian law," said Jodie Emery, Marc's wife.

In January, Emery revealed he was working on a plea bargain that would allow him to serve the bulk of a five-year U.S. jail term in a Canadian jail although this deal would not avoid extradition to the U.S. As part of the plea bargain charges against two of Emery's colleagues would be dropped.


Emery is facing extradition to the U.S. on charges of conspiring to distribute marijuana seeds, conspiring to distribute marijuana and conspiring to engage in money laundering after being busted for selling seeds to U.S. buyers. By striking a plea bargain he would avoid extradition and a possible 20-year jail term. Emery, 50, runs a pro-marijuana media empire and heads the B.C. Marijuana Party.

The court date was adjourned until April 9 due to confusion over whether Canada will accept the deal.

The Canadian government's problem is that a Canadian judge cannot be ordered to impose a U.S. prison sentence of no release for at least five years because it is stricter than Canadian law requires. In Canada, a prisoner is released automatically after serving two-thirds of their sentence.

Emery said her husband is in good spirits and the pair are expanding their Hastings Street store.

"He's always upbeat. He's an optimist," she said.

Marc's point of view according to The Canadian Press Release I found interesting:

Emery said outside B.C. Supreme Court that there's a disagreement about the legality of the deal in Canada.

Emery said that in the U.S. system a non-violent first-time offender like him would normally be released in about 20 months but American authorities refuse to accept that.

He also said he finds the whole process odd.

"The Canadian government could just have me charged and that would lay the matter to rest and they wouldn't have to be concerned because some judge would come to a determination as to whether I should be incarcerated," he said.

"This to me is more like collaboration with the United States. It's like outsourcing our justice system to the United States.

Our own Penal system is sourced to "Contractors" such as Corrections Corporation of America. I'll let you guess who the larger share holders are.
I see something terribly wrong with being able to buy stock in a company that profits from locking up your neighbors for the feds and state.
Unfortunately what I saw developing with American Corrections, I see with the same style of "Contracting" going on in foreign wars.
I saw shit inside the Federal system that scares the bejeebus out of me. There ARE ways to lose people in the Federal system. PM if you want specifics. eek
