I think it's great that we know about handlers causing false alerts. However, wouldn't it be almost impossible to convince a judge or jury that although contraband was found in your vehicle, that the dog didn't really find it?
I know that dogs aren't infallible. I know that handlers can cause false alerts. I'm on the right side of the prohibitioin line. Yet, I would still look at someone funny if they said "the cops found pot in my car, they were using a dog, the dog didn't find it but the cop did."
I think a judge will someday be convinced to suppress the evidence if the dog alerting was video taped and a trainer explains how the dog was talked into the alert.
This has never been tried in court before but is coming soon. I have several offers to be an expert witness on this matter. I will report when this happens.
