What Happened: Pulled over for driving under suspension. the cop told me that my car was going to be impounded & searched. What was weird was when a K-9 unit showed up not even 15 mins after id gotten pulled over & before the cop had actually told me anything about searching my car. which he didnt ask, just told me thats what was going on.
Busted with: baggies, scales, 70g of bud(already pieced out), 20 Adderall(in an unmarked pill bottle), 4 MDMA pills, 2.5 sheets of LSD(without the lines drawn on them) & enough info written down on paper to make it look like i am running a drug ring...all in the trunk of course.
End Result of that Nite: altho the cop told me that i should be brought to jail for trafficking, they let me go and only charged me with the DUS & that they were going to wait until they got the lab test results back from the rest of the drugs they found. this happened almost 6 weeks ago and still no court date, no test results, no nothin?
Questions:
- does this sound like felony material?
- what information should i know about indictments?
- Surveillance?
- why wouldnt they have taken me straight to jail & held me til my court date or results from lab were in?
- this is my first offense but im pretty sure that there are no loopholes in my case...what if a lawyer doesnt want to take my case?
- how many years of prison time should i expect?
- what is the LEO protocal for a situation like this?
- altho i dont really like to talk about my mistakes and regrets since ive already thought about it enough to cook a hot pocket...could i have said NO to then searching my car even tho they didnt *really* ask?

If they did arrest you for the DUS then there is no way you could have refused the search. They have the right to conduct a complete inventory of your vehicle before it gets towed.
The only reason I can think of that they did not arrest you for the drug charges was that they they did indeed want to wait for all the lab results to make sure you got charged with the right charges. It is no problem for them to bring the charges later with an arrest warrant.
Yes, I would be concerned about surveillance if I were you and yes, having MDMA and LSD are most likely felony material.
As for how much time you should expect...that all depends on your state. You can do a google search for "criminal statutes (insert your state)" and you should find a listing of all your states criminal statutes and the possible time one would serve for breaking them.
Also, if you have enough money a lawyer will take your case, but again, it will cost you. |

so this event occured Nov.9 and i got indicted on Dec. 21 for 4 counts of trafficking in drugs. i have a F5, two F4 and an F2. talk to my lawyer tomorrow. spent the weekend in jail and had a $50,000 bond. totally sucked. BAD> |

Here is kinda of a defense that i planned to use if i ever got caught. There was a link to adventuresinlegalland.com search for the drug war is a scam, in the video he talks about them having no legal backing for prosecuting you on drug charges.
Something called corpus delecti (body of the crime) without it it is not a crime. Watch and read its a long shot but if you are out of options.

I have seen this happen to people:
Several people i have known had beat cases against them in State courtrooms. These same people were indicted and brought under same and similar Federal charges. It is possible to be convicted by the Feds if you beat a state case. The Feds can do it under various conspiracy laws.
LSD is definitely Federal. All they have to prove is that you affected interstate commerce. You got busted on a road right? Guess what? If taxes get paid on it, the Feds can pretty well claim jurisdiction. Think Al Capone.
Really depends on what the state wants to do and what sort of information they think you could provide. The Feds don't bluff. Remember that... |
