Can a cop have a dog smell you? Ive asked this a couple times in the midst of my other questions but it never gets answered directly. Ive heard that it is illegal to have them smell you, its only legal for them to smell your vehicle becuase the dog can bite you and injure you. Is this true or not?

From what I can remember Narcdet stating, the dogs at airports are the main ones that are trained to sniff a person. The dogs on street patrol are more focused on finding your stash hidden somewhere other than on your person.


Im pretty sure thats basically what he said about that question.

Unless you are on an international flight it is VERY unlikely that you will be sniffed as a person. As previous posts and proper research dictate the civil liberties associated with a personal sniff are hard to hurdle. So unless you live or work in a government restricted area you cannot be constitutionally sniffed by a dog. If you did your research you know anything you touched with potentially contaminated hands can lead back to you if the dog sniffs the contaminated (touched by hands that touched pot w/o being washed) surface which you only touched or can be tied directly to you. Dogs sniffing a person is higher on the civil rights than sniffing an object (luggage or vehicle) and as far as I know a dog, unless a person is returning on an international flight. Dogs are not (Handlers are not allowed) a dog to sniff a person looking for their drug scented toy.

As already stated by others above, a regular police patrol K-9 will not sniff your person. However, as also stated, just because it is on your person and not in your car it does not mean you are safe. If any of that scent transferred to your vehicle or baggage and the K-9 hits on it you WILL be searched.

In Horton v Goose Creek ISD (5th Circuit) and Doe v Renfro (4th circuit I believe) dogs cannot sniff the person of school students. It is my understanding the Texas Attorney General order never recended makes it illegal to search a person with a dog without probable cause.

That is a stupid act by police because if the dog injuries the person there could be serious civil and possible criminal consequenses.

would it be smart to carry a sack of bud in your pocket? If you wrapped it good and cleaned and what not to get the dust off and change clothes and take other precautions. Or if your getting your car searched by a dog would the dog be able to smell it and alert?
