Hey Barry,
Landon from kentucky here ; I posted a long read in the experience section and I figured that you might not have to time to read it all so I was just wondering if you got the time to look at these than you could help me with some general answers. I understand that two questions involve house procedures instead of car but I thought that you would have a way better understanding than myself and I'd go to you for help.
When my friend was constantly asked by the officers for permission to contact his parents at the bar they where at the officers denied him and repeatidly asked for consent to enter the house; since my friend denied them consent until his parents were informed and decided whether or not to give consent to enter their house, was it there for illegal for them to enter like they did? (the door was locked and they used his key that they found in the pile of items after frisking and searching him)
My 2nd question is more brief: Is it legal for the child (under 18 ) that is not the home owner give consent to enter his parents house, or would they infact need the home owners consent
And finally: As i was leaving the officer that threatened to pull me over for no reason and search me and my car when I enter that city (which is actually the city that I will be attending my last couple of months of highschool in) if he actually pulls me over for no reason could I infact file a harassment charge against him?[/code] |

Landon,
I scanned your lengthy story last night and scanned the story you just posted here. Lengthy stories do not bother me a bit and I encourage citizens to "report" whatever is important to them no matter the length.
However, I must spend a little more time with your questions and will answer them by Friday this week. Might be tomorrow but give me 'till Friday.

Police are not suppose to pull you over without having probable cause i.e. traffic violation. Police will lie and claim you failed to maintain a single marked lane or claim you were speeding. If you are pulled over for no traffic violation, sue the cop and his agency for illegal stop.
I hesitate to answer your other questions because of your age. You deserve to have good information no matter your age but I must check the legalities of advising minors. I teach my kids the truth but might be in trouble teaching other kids. I just don't know yet but will find out.

The adult/child must be of reasonable age (what ever that is) and must be in a state where he or she knows what they are allowing. (In my training this meant 12 or older) It DOES NOT have to be the owner of stated property and here is the catch; if you are a renter your land lord can give permission for a search. |
