Also, the first time i got arrested the police found about ten small weed flecks in a box (which they broke) in my dorm room and they took this box....
after about eight months, being cleared of the charges, and numerous e-mails asking for it back i finally got my box back (my cousin got it for me from Iraq so it was special) and the exact flecks of weed i had been arrested for were in the box.
I asked the officer who just gave it back to me if i could be arrested for this weed again and if so would he please clean the weed out becasue i didnt want that to happen.
He told me no he wouldnt clean it out and to make sure "i use a high power vacuumm to get the weed out and to drive carefully on the way back"
Can i be arrested twice for the same weed, would that be double jepoardy....and is it the police station even allowed to give drugs back to the people they took it from??
Yes, they should have cleaned it out and yes you could get arrested for it again. As long as it is in your possession you can get busted for it. Double jeopardy would be getting tried twice for the exact same charge..meaning getting tried twice for the ORIGINAL finding of the weed. If you got stopped after picking up your box and they found weed in it that would be a whole new charge, so you could be charged again. Stupid but true.
