I have gotten great difficulty trying to get this question answered
Say a person ordered seeds, and was caught doing so
If nothing is planted, no paraphinilia is present, no mj is anywhere on the premises, everything is completely clean...only thing around were some clean planting seeds..not even any growing equipment of any kind..what exactly would happen?
I'm not obviously talking about having them in my car, but I figured this would be a good question to ask |

According to US law unsterilized seeds are the same as fat sticky bud.
Marc Emery is currently awaiting trial to see if he will be extradited to the US, to be tried as a "major drug king pin" for selling seeds to customers in the USA. |

from many various forums, people say when seeds
were ordered, it will either be delivered to
order place or simply get confiscated and you get
a letter knowing you its got confiscated at custom.
As long as its just 10 beans, it won't cause
major trouble.
That's what most people say at the forums. |

In Texas the definition of marijuana includes its seeds and stems...HOWEVER...in order to be charged with Possession of Marijuana, you must have a "usable amount." Seed are not a "usable amount" so they are considered Drug Paraphernalia. In Texas, possession of drug paraphernalia is a Class C Misdemeanor comparable to a traffic ticket.
Check you State Law. Marc Emory's situation is totally different from yours.
GG is correct in suggesting you should be O.K. with just seeds.
Also, try poking a small hole in a bag of mixed nuts. Drop in the seeds, shake and wallaaa!!!! You have basically created invisible seeds that are nearly impossible for a cop to detect.

Old post, but......
1. Seizures common, to date , little follow up (1-2 cases known out of 10's of thousands for larger , repeat orders.....(Green tape, homeland security)
2. That very well could change at any time now or in the future....Enforcement and prosecution over the years of MJ in general always touch and go.....sometimes it's hot, then cools down, etc, this year, of course an election year, so....next year?...might very well be changed again (better or worse).....that is for enforcement in general....
Emery and HS situations good example, as, not the first time US has gone after seed vendors.....and, most likely, not the last...
3.The big picture though, regarding the above and misdemeanors is, it is technically importation, which is Federal...(smuggling)
Regarding Emery, they are hitting on a special federal classification, which includes over 60,000 (lbs, plants, etc.....of course, which is absurd to begin with...)
In some cases, it will be claimed every seed is a plant, and corresponding significance, and retail/end value..
This actually shouldn't be a concern, except for most seed vendors have a problem with a customers security.....and don't ship as they should (and, btw, methods should never be discussed anywhere in print, but, likewise, should be changed often by vendors, and, again, a purchaser can do many small things to assist (using different source countries and vendors, requesting "special" packaging, shipping, etc.... |
