Please share any info regarding Law Enforcement using discretion in making arrests or writing a citation. For example, at traffic stop, a Police Officer decides for whatever reason that he/she is "cutting you a break", and is "letting you go this time". In doing so what does he/ she do with the suspected drugs? Of course, I am referring to a "small" amounts that would be found.
Additionally, where can I get further information regarding this topic in terms of text or media?
Any feed back is greatly appreciated and valued. Thanks in advance. |

| There are a GOOD amount of police out there that are OK with marijuana. That number is growing. Police are here to protect us, they should be our friends. They save our lives sometimes and protect us. Police should want prohibition to end so people dont view them as pigs etc etc. |

| The proper thing for an officer to do if he was not going to charge you with the drug would be to seize it and turn it in to be destroyed. However, this does require a small amount of effort and paperwork on the officers part and many might take the option of throwing the drug on the ground and grinding it etc. to dispose of it. As others have stated here, I suppose some officers might take the contraband and use it themselves, but I suspect that is a very small number of officers. |

A friend of mine recently had $4,000 in cash and a good amount of meth taken out of her purse and released by a well known LEO in my area. Surely he's not in that "very small number of officers" that take contraband and use it themselves. No small amount of "paperwork" or "foot-grinding" seen either. HUH? |

If the officer took the meth and the money and did no incident report then your friend should actually go to the police dept. and file a complaint. I know it sounds stupid but if the officer actually did that..and I'm not calling your friend a liar but I myself have been accused of stealing as much as $5,000 after arresting someone when they did not have any money at all, so I know that false accusations occur...anyway, if the officer actually did it your friend should complain, and she should be vocal about. She should demand to take a polygraph and also demand that the officer take one as well. Could she get in trouble for claiming to have had meth in her purse...maybe, but probably not. However, you never know, this officer may have had other complaints filed about him taking peoples money etc. and the department may be looking for a reason to investigate him further. Since meth was involved they will probably make him take a piss test and if he comes up hot then he's fired.
There are alot of options here..but instead of anyone using them they prefer to just sit and bitch about cops. I'm a cop and I can tell you that I don't want to work with cops that steal etc. because it makes all the cops that aren't crooks look bad. |

Cresting the top of hill leading out of city, the police cruiser that pulled out behind me a few miles back before entering the city limits. F.Y.I., this is not a huge city by no means. It has one high school, not a single building over three stories, many of its' populous in rural areas. It does however serve an important role in this areas progress as it sits on the edge of two other major counties in the state.
Now I was speeding when passing him a mile before entering the city limits, but no more than ten miles over. As you enter the city limits it stays 55 m.p.h. for another mile then drops to 45 m.p.h. for the last leg through the city. This area is enforced due to several fatal accidents caused by drivers speeding, so it isn't uncommon to find cruisers in this area watching for D.U.I. offenses and speeders. I never go over 50 during the day and never over at night. Let me say this. I drive through this city daily and am very comfortable when a cruiser gets behind me. Not this time.
Cresting the top of the hill the cruiser flips his lights on, I then signal that I am pulling over to the left. Doing everything I read about in the our state's drivers manual, and other personal incidences(ones not as close a call such as this). I put the car in park, turn the overhead light, then place my hands directly back on the steering wheel where they stay the entire time, unless the cop has asked me to move them. I also refrain from looking at my passenger while the officer was in his cruiser. I continued to talk him, but obstained from turning my head all the while. The officer then approached my vechile, which had a dealers plate on it due to my employment with a dealerhip. He asked for my passenger and I's license and/or identification. We complied. He returned and asked if I was aware of why I was pulled over, and I told him no I wasn't sure. He said at first I had tossed a cigarette butt out of the window, which it is against the law here. I didn't argue that, even as my butt set smoldering in the ashstray. Then upon returning he mentioned I was speeding, and finally after all is said and done he asks if I had been drinking. I had been at the tavern that day, and certainly was buzzed. He made me exit complying with a breath test, as well as a soberity test. This must have satisfied him, as I only blew a .08 bac. None the less saved myself from embarassment through the soberity test. He politely asked for me to return to my vehicle as it was mid febuary. He then returned asking me to exit the car one more time. I thought this was it. Closing my door he returned our id's to me, then asked if there was anyone that could come and secure my car and take me home. In a calm manner I replied, Yes I do. My father and it will not take him very long to get here. So the trooper took me down the road to use the phone, and my father was there shortly.
I am so thankful for not smoking the only joint I had on me, as I could have easily done so. Not to mention I am thankful he chose not to search the car as I had notice the person with me threw his quarter bag of TINA underneath my seat. I am deeply thankful for whatever was on my side that evening. IF it was karma or my polite dispostion. THANKS. |

I have been given a break on 2 occasions.
One time I was the passenger in a car and the driver was arrested for DUI. I had a freshly rolled blunt in the side of my door and the officer unrolled and dumped it. I was underage and heavily intoxicated but the officers let me walk to my house which was about a mile away.
Second time I was at a convenience store and the officer asked me to grind my bud into the pavement.
I don't know if this counts but i was pulled for doing 35 in a 25 and was told to "slow it down." I did have a little bud on me. |

| I just recalled another time where I wasnt exactly given a break but got away. I was taken out and searched the cop looked into my cigarette pack with a mag light and fumbled around. My eyes hit the ground and I KNEW I WAS BUSTED but he then handed me back my belongings and told me to be safe or something of the sort. I had 4 or 5 roaches in the pack. |

If I were Nightcrawler from the X-Men, or at least possesed his mutant ability. I would have excused myself, and found my way to the bathroom (oh wait there was a gal and guy occupying it). Hmmm!!! Well, POOF!!!
Thankfully people are (or at least can be) understanding. It was the dead of winter. I had been convinced by a friend to travel North with them (other words can I give them a ride) so that they may relinquish their reign as winner of this contest. Like many times before I agreed. The weather was frightful, stress levels were rising, but we made good time. Being on time is extremely crucial especially when holding a title. We checked into the room that had been provided.
It took a second as the person I had been invited by suddenly got cold feet. Go! Figure! Towards the end of the night, as the bar announced last call I had been struck up for conversation by a local. He invites me to an afterhours outdoor hottub party. I accept believing that another person had invited me. In all worked out in the end, but I had been at the party for a few hours when I asked if it were okay to smoke a joint. He laughed. then replied with the statement that half the attendees of the party were local law enforcement. OOOOPS!!!! |

Got cut more breaks than I ever really deserved, but then I was really unresponsible. Most I ever got was an M.I.P. long time ago and a simple posession charge 9 or so years ago.
Now when I drink I cab it. Still walk around with MJ and reeking of it. LEOs around here know me well as I work bar security, guess I'm kinda lucky that where I live LEOs don't bother with MJ... as long as you're not pissing them off.
P.S. Been through TX many times. Lotta those LEOs are pitbulls. Good to have one on our side, Thank you for what you do Barry! |

The times that I got out of tickets and OWIs was when I dropped my uncle's name...he was lieutenant of all the black & white cars in Des Moines at the time. I, in all honesty, had no clue as to his rank; I just thought the cop pulling me over might know him. Making conversation, you know? Later in life I learned why the reactions to his name were so funny. One cop, can't remember his name, for some reason was talking to me at the passenger window instead of my then husband's driver side window. My husband, Dave, was very drunk. When I dropped Paul's name, this guy threw his head back, laughing, dropped his ticket pad to his side, walked in a circle laughing, and finally stopped. He said he'd let us go (if I drove) if I agreed to grant his request upon seeing Paul. I was to have Paul lay on his stomach, take his baton, place it across the back of his ankles, and then stand on the ends of the baton and bounce up and down. If I would do that, and remember his name, he'd just give us a warning.
The funny thing is, Paul hates my ass. Always has. He would have patted them on the back and said, "Good work!" |
