| My good friend got busted with delivery of marijuana 1000 feet of a school/church. This is his second offense next to a possession of a controlled substance charge. The amount he had was under a quarter. He believes his name was thrown out there by a CI who flipped to save his own ass. The police did not arrest him for an entire year after they supposedly caught him. Technically, this was his first charge since they didn't apprehend him until after the possession of controlled substance charge stated earlier. What do you guys think will happen to him? He is unsure if he was even busted illegitimately with actual proof or if it was just say so. Should he plea guilty and get a plea bargain or take his chance with not guilty and file for motion of discovery? Any advice would be helpful in this, I would hate to see him go to jail and would like to give him sound advice. Thank you all. |

At the State level, a Motion of Discovery should disclose confidential Information sources.
At the Federal Level, its a little different. If there is a C.I. and that person is still actively generating case material for the Investigator, he may not disclose this source and cover it as a anonymous tip by a citizen. They protect Snitches other ways as well.
Ive met numerous people who did not find C.I.'s disclosed in Discoveries!
Remember this: A Confidential Informants testimony carries the same weight as physical evidence in Federal Court! |
